Introduction

It is no secret that obtaining a U.S. visa can be a difficult and sometimes lengthy process. With countless stories of rejection, frustration, and confusion, many people are left wondering why it is so hard to get a visa USA

In this blog, we will explore the various factors that make it difficult to get a U.S. visa. We will also highlight some common steps to follow by which you can increase your chances of achieving success and make the process much easier.

Reasons For Difficulty In Obtaining A U.S. Visa

If you’ve ever applied for a U.S. visa, you know just how complicated and lengthy the process can be.

From filling out multiple forms to undergoing an interview and providing a range of documents, the visa process is complex and can be intimidating.

Here are 10 reasons why it is so difficult to get a U.S. visa:

1. Strict Security and Background Checks – The U.S. government is extremely cautious when issuing visas, and the process for obtaining a work visa USA is designed to weed out any potential security threats. As a result, applicants must undergo an in-depth security and background check, which can take an extended period to complete.

2. Lengthy Processing Times – Even after an application is submitted, it can take months for the U.S. government to process and approve it. This is especially true for applicants from certain countries, where visa processing times can take up to a year or more.

3. Complicated Documents – All USA visa applicants must provide a range of documentation to prove their identity, travel purpose, and visa eligibility. This can include birth certificates, bank statements, travel itineraries, and other documents, which can be complicated to obtain and submit.

4. Visa Interviews – Most applicants must attend an in-person interview at a U.S. consulate or embassy. During the interview, the USA visa officer will ask the applicant a series of questions and review their documentation to determine their eligibility for a visa.

5. Different Types of Visas – There are a variety of visas available for travel to the United States, and each one has its own set of requirements. This means applicants must research the different types of visas and determine which one is best for their purpose of travel.

6. Costly Fees – All visa applicants must pay a non-refundable fee to process and issue a visa. Depending on the type of visa, these fees can range from a few hundred to a few thousand dollars.

7. Lack of Availability – Depending on the country of origin, a USA job visa may be limited or unavailable. For example, certain countries may not have any U.S. embassies or consulates, or the U.S. government may not issue visas to citizens of that country.

8. Strict Eligibility Requirements – Even if an applicant meets all the requirements for a visa, the U.S. government has the final say on who is eligible for a visa. This means applicants must meet all the necessary criteria to be considered for a visa.

9. Frequent Updates – The U.S. government is constantly updating its visa policies, so applicants must stay informed of changes or new requirements. This may add more layers of complexity to the US visa application process.

10. Lengthy Appeals Process – If an application is denied, the applicant must be able to appeal the decision. However, the appeals process can be lengthy and complicated, and there’s no guarantee that the appeal will be successful.

Getting a visa usa is not easy; the above points demonstrate why it’s so difficult. However, with the right preparation and understanding of the visa process, it is possible to obtain a visa and travel to the United States.

Tips For A Successful U.S. Visa Application

Happy Man Successful US Visa Application

1. Make Sure You Meet the Eligibility Requirements: Before you submit your application, make sure you meet all the eligibility requirements for the visa you’re applying for. This is the most important step, as any mistakes or omissions can lead to the denial of your application.

2. Submit Complete and Accurate Documentation: When submitting your application, make sure all the required documentation is complete and accurate. This includes a valid passport, financial documents, and proof of your ties to your home country.

3. Show Proof of Sufficient Financial Resources: The US visa application requires valid proof that you are able to support yourself financially in the US. This includes showing proof of sufficient funds to cover your stay, as well as any dependents that might accompany you.

4. Demonstrate Your Ties to Your Home Country: The US visa application process requires that you demonstrate strong ties to your home country, which would encourage you to return once your visit is complete. This includes documents such as proof of employment, evidence of family ties, and documentation of any investments or property you own.

5. Participate in an Interview: During the US visa process, you may be required to attend an in-person interview. During this interview, you will be asked a series of questions about your background and the purpose of the visit. It’s important to be prepared and answer the questions truthfully and clearly.

Following these five steps can increase your chances of getting a visa. However, a well-organised and complete application is the best way to ensure success. Ensure that you have all the required documentation that is correct and up-to-date. Good luck!

Don’t blow your chance to visit the country of dreams due to lack of preparations or unprepared interview sessions.

US visa interviews can be quite tricky to crack. Especially in cases where the candidates do not prepare well for such interview sessions.

Presenting the most impressive form of yourself should be the goal that you must aim for. From your body language to your dress-up and communication skills, everything matters in this interview.

There are a lot of things that you need to keep in mind before stepping a foot out for this interview session and before involving yourself in the process of getting a H1B Visa

Are you unaware of these aspects of the interview? You have landed on the right page.

This article covers different tips that will help you to boost your performance in the US immigration visa interview:

Let’s dive into these tips and help you crack the interview faster by discussing a few things to keep in mind.

Dos For US Visa Interview

US visa interviews have a long list of what are the things you must not do and keep in your mind. Let’s first discuss what you should keep in mind before entering your interview to make an impressive impression on your interviewer.

Also, you should note various US Visa interview questions for better understanding:

visa interview dos and don'ts

1. Be To-The-Point

One of the qualities every interviewer looks for in a candidate is to be precise. Don’t stretch the answer for any question and restrain from providing any additional information unless asked.

This gives an impression of being straightforward, concise, and smart to the interviewer. This will certainly help you to get better scores.

2. Clear Your Motive

Make sure you do not put an impression of settling in the USA if you have applied for a certain course or job profile. You can highlight how well you are connected to your nation and how certain factors influence your return to your nation.

Enlisting various connections to your nation such as financial, emotional, family background, interests, and others can help you clear your motives properly.

3. Speak Independently

While answering the different questions asked during this interview session, make sure you speak independently. It means that you must put forward your thoughts and opinions to impress your interviewer and be efficient while answering cross-questions.

You must not carry any companion unless stated otherwise. In many cases, the parents are asked to join the minors to answer a few questions about funds, interests, and others. You may take your parents with you in such cases however, the overall interview answers must not be affected by them.

4. Be Confident

Confidence is one of the qualities that reflect this. During your interview for any of the US visa types, you must be asked various questions that might challenge your intellectual or technical knowledge. In such cases as well, make sure you confidently deal with the answers and stick to your concepts.

If you show confidence while answering your questions, the interviewer will certainly reflect the same energy to you.

5. State Only The Known Facts With Supportive Figures

One thing that you must keep in mind while answering technical questions in the US visa process interview is to keep it technical!

Provide detailed yet accurate answers with the facts that you know well. You can also add some supporting figures if you are sure of the exact number or figure.

In case you are not sure of the exact number, you can simply mention it with words like approx and around.

6. Know Your Goals

While applying for the visa, there must be a certain goal you set for yourself.

Be it your US visa application for higher studies or simply the USA job visa, you need to know your goal accurately.

Most of the questions covered in the  US visa  interview sessions will contain in-depth questioning about the course/program/job as well as some technical aspects associated such as funding and asset management.

To make sure that you can answer these questions efficiently, build a roadmap on your own and research it.

7. Positive Mindset

If you think good, you will attract good things automatically!

During the interview process, there might be a few instances where you will feel that everything is going South. If this happens to you, make sure you keep a positive mindset and approach that will further help you to handle the situation.

Instead of panicking or giving up in the instances where you do not know the answer to a certain question, you can simply turn it down with a positive approach and efficient answer.

Simply, reply with everything you know about the question and inform the interviewer that you might have limited information about this concept and hence, you can not provide a detailed answer.

As discussed earlier, the list of don’ts for US visa interviews is quite long too.

Let’s have a glance at a few things that you must restrain yourself from during your US visa interview.

Don’ts For US Visa Interview

Are you planning to go to your interview in the new sneakers you bought? Wait! It might blow your chance to visit the US real quick! Other than your sneakers, there are various other things that you must keep in mind before appearing for this interview session. These factors are:

  • Dress to impress. Make sure you do not include any funky accessories, tattoos, or clothes in your attire while stepping out for this interview
  • Restrain from providing half-baked knowledge or wrong digits
  • Don’t frame your answers directly from an online page. Make sure you reflect the authenticity and genuine effort behind each answer
  • Be right on time for the interview. Keeping your interviewer waiting is the biggest red flag
  • Do not mess up with the documents. Ensure that every document you provide to your interviewer is in a presentable stature.

The United States of America welcomes visitors from all over the world. The visitors arrive for various purposes such as employment, tourism, permanent immigration, business trips, etc.

However, the only route to get entry to the US is through a visa. Therefore, if you embark on an international journey, you must know all travel requirements to avoid mishaps.

Now, there are different Visas available that suit other purposes. For example, for tourism, you need a tourist Visa and for employment, H-1B Visa.

In this blog, we’ll look at the insights of H-1B Visa and the US Visa Process.

First, let’s understand the H-1B Visa in detail.

What Is An H-1B Visa?

H-1B, sometimes called a Nonimmigrant Work Visa, a foreign  employee seeks an H-1B Visa from the US government which will grant them permission to work for the US employers in their country. To qualify for the H-1B Visa Process, candidates must have a bachelor’s or equivalent degree.

Now we know the meaning of the H-1B Visa, so let’s know its eligibility criteria.

Eligibility Criteria For H-1B Visa

Here is the eligibility requirement that you must fulfill in order to obtain for H-1B Visa:

  • Candidates must have a job offer letter from a US employer.
  • You must possess all the equivalent knowledge regarding the job role, For example, a bachelor’s degree.
  • Employers must submit the application stating that only a few qualified US applicants for the job role they are offering you.

After taking the eligibility criteria into consideration; it is essential to  look at the H-1B Visa Process.

What Is The H-1B Visa Process?

When prospective employees are selected for the H-1B Visa, their employer must file a petition representing them.

Therefore, employers submit Labor Condition Applications (LCA). The LCA goes to the Department of Labor to qualify for certification. Its primary purpose is to extract confirmation from employers that they will pay the same salary to the nonimmigrant as their US employees.

The H-1B Visa Process

Moreover, to confirm that foreign employees’ living conditions would not affect the current employees.

Once your employers confirm all these conditions and are selected for the same, they must file Form I-129 Petition to LCA and USCIS. They have to pay additional fees and documents. These documents include the following:

  • Education evidence
  • Training certificate
  • Membership documents
  • Resume
  • Employment confirmation letter
  • Letter of support

When the F-129 Form is approved by both LCA and USCIS, employees must wait until their H-1B Visa status goes live. Then, if you are outside the US, you must apply for consular processing.

You have to present for the Interview with valid documents. Once you pass the H-1B Visa interview, you will be offered a green card. You can check all your visa processes at your USCIS online account.

Now you know every detail before you apply for an H-1B visa, let’s move further and learn about the US Visa Process.

What Is A US Visa?

In order to enter the United States of America, you must have a Visa. You will be granted a different visa that suits your travelling purpose.

  • For employment opportunities, nonimmigrants get H-1B Visa.
  • For further studies in a prestigious institution in the US, students are granted M-Visa.
  • J-Visas are granted for Exchange Visas.

Check whether you are eligible for a US visa if you want to travel to the US for any of the earlier-mentioned purposes.

Eligibility Criteria For US Visa

  • Country’s passport with six months validity and three blank pages.
  • The candidate should not have any criminal record.
  • Applicants should have a bachelor’s degree for employment or business purposes.
  • The candidate’s spouse must apply for H-1B Spouse Visa separately.

Your US Visa application will be rejected if you don’t meet the eligibility criteria.

What Are The Document Requirements?

For Visa, you require the below-mentioned US Visa documents:

  • A passport must have at least six months of validity date.
  • One passport-sized photograph.

Finally, to get the US visa application, the candidate has to pay a $160 fee. If your Visa is granted, then you will pay a reciprocity fee. It differs from country to country.

Once you meet all the eligibility criteria and present the required documents, you must fill out the DS-160 Form and pay the application fee. Finally, you will be called for a US Visa Interview to confirm your travelling purpose and Visa.

What Is The Interview Process?

All candidates between 14 and 79 years of age must undergo a US visa interview. It is a mandatory process to obtain a US Visa. Therefore, nonimmigrant applicants must contact the US consulate or embassy to schedule the interview appointment. You should seek an interview appointment the moment after submitting the DS-160 Form.

You will get an Interview Confirmation Letter that mentions the interview date and timing. So, present this letter to the consulate office to allow your Interview to commence.

Along with the interview confirmation letter, candidates must compile all their documents in front of the US consulate. It gives them proof of your eligibility for a US Visa. Finally, you attend the US Visa Interview.

Things To Remember Before Presenting For A Visa Interview:

  • Always appear on time or some minutes before the scheduled time.
  • Be honest in the Interview.
  • Give relevant answers.

When you apply for a US visa, you must submit manifold documents as part of your application. These documents will be used to assess your eligibility for a visa and will also be used during your visa interview.

For example, if you are applying for a student visa, you must submit evidence of your enrollment in the course of study. If you are applying for a US work permit visa, you must submit evidence of your employment offer. In addition to the documents specific to your visa category, you will also need to submit some general documents.

This article will give you proper guidance about the documents you need for a visa Interview. Read on!

Who Must Attend A US Visa Interview?

A US visa interview is required for anyone who wishes to enter the United States for any reason. This includes both business and pleasure travellers. The interview is conducted by a US consular officer at a US embassy or consulate and is required for all non-immigrant visa applicants.

There are numerous visa types, and each one has its requirements. The visa type you will need relies on the purpose of your visit.

  • If you are planning to visit the United States for business, you will need a business visa.
  • If you’re considering visiting the United States for pleasure, you will need a tourist visa.
  • And, if you plan to study in the US, you will need a student visa.

The US visa application process can be confusing, but it is important to ensure you apply for a US visa online correctly. The ideal way to do this is to consult an experienced immigration attorney or a visa consultant.

Once you have determined your visa, you must complete an application. The application will ask for common data about yourself, such as your name, address, and date of birth. You will also be asked to provide information about your travel plans, such as your flight itinerary and hotel reservations. After you have completed the application, you will need to submit it to the US embassy or consulate in your home country. You will also need to submit a photograph and pay a fee.

Once your application has been received, you will be scheduled for an interview. The interview is important for the visa application process, and it is your opportunity to demonstrate to the consular officer that you are eligible for a visa.

After the interview, the US visa consular officer will determine whether or not to approve your visa application. If your application is authorised, you will be issued a visa. If your application is denied, you will be given a reason for the denial.

What Necessary Documents Does One Need To Bring For A US Visa Interview?

1. A valid passport: You have to submit your passport when applying for a US visa. Your passport is accurate for at least six months above your intended stay in the US.

2. A nonimmigrant visa application: You must complete and submit a nonimmigrant visa application. This application is also known as the DS-160 form.

3. A photograph: You have to submit a recent photograph with your visa application. The photograph must meet the requirements specified on the visa application form.

4. Supporting documents: You must also submit additional documents, such as a birth certificate, marriage certificate, or evidence of financial support, with your visa application. These documents will be used to determine your eligibility for a US visa.

5. A visa fee: You must pay a visa application fee when you submit your application. The fee is non-refundable and must be paid in US dollars.

The documents you will need to submit for a visa depend on the US visa types you are applying for. For example, students applying for a student visa (F or M visa) will need to submit additional US visa documents, such as evidence of financial support and a SEVIS fee payment receipt. Business visitors applying for a B visa need to submit evidence of their business ties to the United States.

When you apply for a visa, you must submit the required documents and pay the visa application fee. You must also schedule an interview at a US consulate. If you are planning to visit the USA, it is crucial to ensure that you apply for the right visa and attend your visa interview. The post How Long Can An H-1B Worker Stay In The United States? appeared first on .

]]>
The H-1B visa is assigned to nonimmigrants by the employer, which allows them to work temporarily in the US.

Therefore, H-1B visa holders cannot permanently live and work in the US.

Wondering why?

Well, their stay depends on the visa’s duration date. When the duration date of the H-1B visa expires, the holders must leave the US and apply for a new work visa USA

Note: Workers who continue to work in the US with an expired H-1B visa are immediately deported and lose their legal status.

The US law states that an international worker can live up to six years in the US with an H-1B visa (including the number of extensions one can get).

However, it means that the original date of the H-1B visa is only valid for three entire years, which is extendable to another three years.

Once a nonimmigrant completes these six years in the US, they can acquire a different immigration status.

Must-know fact: The F-1 and O-1 visa holders often get a green card to stay permanently in the US. Otherwise, their visa’s eligibility lasts up to six to twelve years.

Now, let’s understand how the time is calculated for an H-1B visa according to US law.

How Much Time Does US Law Allow For The H-1B Visa For Foreign Candidates?

Before you get into the exact time count in the six-year H-1B visa validity, you must know how it is calculated in the first place.

  • A worker’s time in the US counts at the end of six years. Therefore, it won’t affect your H-1B status even if you have been to another country within this period, whether you leave the US or re-enter the US.

For example, suppose an Indian Citizen with an H-1B visa has a validity date from 1st February 2018 to 31st January 2021. During this period, the worker visited his family in his own country for three months. So, those three months won’t be counted from his H-1B status.

  • It is a significant law as it allows international candidates to get the most out of the six-year validity.

For example, the Indian Citizen having an H-1B visa from 1st February 2018 to 31st January 2021 has spent three months in his own nation, i.e., from 1st January 2019 to 31st March 2019.

As a result, the new validity of the work visa USA will be up to 30th April 2021.

  • The same H-1B concept applies to the L-1 visa holders, who can complete their six years in the US.

Discussing the L-1 status here is essential because some workers frequently shift from L-1 visas to H-1B visas.

So, let’s learn how they calculate the six years of their L-1 and H-1B status periods.

Similar to the H-1B visas, the recapture concept applies to L-1 visa holders. So, if they spend some time in another country from their allocated period, that time won’t be counted. Hence, the L-1 holders can apply the remaining time in their H-1B status.

Noteworthy point: The recapture concept is inapplicable to the dependents of H and L visa holders. The dependents must leave the US once their validity expires, even if they had stayed some time in another country.

To avail this opportunity, H-4 visa holders (dependents) must apply for an H-1B visa.

For example, a worker has an H-1B visa, and his wife accompanies him with an H-4 ticket. Now, the US government gives the right to spouses to change their visas from H-4 to H-1B. Then, they will be entitled to the recapture concept. Consequently, the spouse’s time on H-4 access won’t affect the H-1B status.

Now, we understand how the validity period is calculated in an H-1B visa. Let’s also look at some exceptions.

Exceptions In The Validity Of H-1B Visas:

Validity Of H-1B Visas

First Exception:

Usually, the maximum validity of an H-1B visa is six years. However, there are a few exceptions that can extend these six years as well. They fall under a US law known as American Competitiveness in the Twenty-First Century Act. It is also referred to as AC21.

An H-1B visa holder can extend the duration of the visa if they are the beneficiary and approved for an immigrant worker petition. The petition is filed under I-140 law. However, it doesn’t mean they will get an immigrant green card, as the H-1B visa date is not up-to-date.

For example, suppose you are an H-1B visa holder and have obtained I-140 in the EB-1 category. Now, your H-1B visa will expire on 30th April 2022.

However, your priority date is 15th April 2020, which means your cutoff date will be 21st April 2019. You can see that you don’t have a priority date before the cutoff date. Hence, you are ineligible to apply for immigration status.

In such cases, you can increase your H-1B visa till your priority date becomes up-to-date.

Second Exception:

You can apply for an H-1B visa process to extend its validity by filing the PERM or ETA application. In this scenario, the candidate’s employer files the petition on their behalf. The petition criteria are I-140.

Third Exception:

H-1B visa holders can extend the validity beyond six years via AC21 provisions. However, as these provisions have significant backlogs, the visa date sometimes extends to 10, 15, or 20 years.

Now, let’s look at another critical factor, i.e., how long the H-1B visa holders’ dependents can live in the US.

H-1B Worker’s Dependents Duration

The spouse of the H-1B visa holder possesses unlimited H-4 access and can continue to live with their husband. However, the exact condition is inapplicable to children as they cannot marry and should be under 21 years.

So, parents can obtain a green card for the family to permanently allow the child to live in the US. Otherwise, children can continue to live under F-1 status as students.

The H-1B visa is the most demanding visa among the rest as it comes with various benefits and opportunities for validity extension.

In addition, this US work permit visa also benefits the applicant’s spouse. Apply for this visa and find a beneficiary who can permit your employment and stay in the United States.

The post What Are The Most Common US Work Visa Types? appeared first on .

]]>
Many international candidates aspire to work in the US either on a short-term or permanent basis.

Therefore, employers grant temporary work visas to US immigrants to allow them to start their occupation soon. Also, it is easy and less expensive to hire foreign employees temporarily.

On the other hand, long-term employees get an E-B1 or E-B2 visa (green card) to stay in the US permanently.

Similarly, there are many work US visa types available for international candidates.

Let’s get into their detailing so that you can know which Visa will suit you. You will also learn about non-immigrant and immigrant visas.

Non-Immigrant Work Visas Types

Employers primarily grant non-immigrant visas to their future employees. They are temporary and thus, non-immigrants must depart from the country at the visa expiration date. Now, we’ll look at the temporary visa types one by one and understand each in detail.

  • H-1 Visa:

The most prominent nonimmigrant visa is H-1B. It is less time-consuming and easy for employers to approve it from USCIS.

Employees only get the H-1B visa when they have the employment offer letter from a US employer. Furthermore, concerned candidates must present all their job qualifications with suitable degrees.

In order to sponsor your H-1B visa, the employers need to file an I-129 petition at USCIS. It is also advisable for employers to seek legal help and hire a lawyer for the process of highly demanding H-1B visa USA. Any mistake in the form may lead to rejection.

  • L-1 Visa:

L-1 Visa is allocated to employees working in the affiliate US-based company from another country. Therefore, the L-1 visa allows employees to transfer from an international company branch to a US company.

To obtain the L-1 visa, employees should have worked in the foreign company’s branch for a year. It is again segregated into two categories, i.e. L-1A for managerial capacity and L-1B for specialized knowledge. Nevertheless, employers must file the I-129 petition for an L-1 visa to USCIS.

  • O-1 Visa:

Foreign candidates possessing specialized knowledge or expertise in any work field are granted an O-1 non-immigrant Visa. Your employer will produce your extraordinary skill set to obtain an O-1 visa on your behalf. However, candidates must satisfy at least three prongs to get this US work Visa.

  • Candidates have high remuneration in their field.
  • They have achieved outstanding contributions.
  • They have been awarded certifications.
  • Candidates have the best performance in their job role.

You must go through the US Visa process to acquire the O-1 Visa. Then, the concerned US employer will fill out the I-129 petition. Additionally, the petition will consist of a letter stating that the employee has no objection to US recruitment.

  •  E-1 Visa:

The US government provides E-1 visas to the countries’ nationals and permits them for trading activities. You can acquire an E-1 Visa as a treaty trader or investor. To qualify for this Visa, candidates must be nationals of the country involved in the trade treaty. Additionally, the applicants must have a healthy amount of money to begin the trade in the US and present some documents as proof.

You can fill out a US visa application form (E-1) at the US consulate in your country.

Note: For an E-1 visa, you don’t have to submit the document to USCIS.

  • TN Visa:

The North American Free Trade Agreement initiated the TN Visa, especially for Canadian and Mexican citizens. Thus, only Canadians and Mexicans can work in the US under this program. Also, they get three-year increment notice from US-based employers.

As it is only allocated to the citizens of Canada and Mexico, so they must submit their citizenship proof. Additionally, produce the employment letter and qualifications for the job role.

Today, the US-Mexico-Canada Agreement continues the application for the TN Visa. As a result, many companies hire accountants, lawyers, teachers, professors, scientists, and pharmacists from these countries under the TN Visa.

These were some non-immigrant work visa types. Now, let’s move further and look at immigrant work visas.

Immigrant Work Visas

Immigration visa stamp

The immigrant work visas for foreigners work as a lottery, as now they can permanently sit in the US and get citizenship. The US government also allows immigrants to relocate to the country with their families.

To qualify for immigrant work visas, your employer should agree to take the sponsorship for the visa program. So, let’s know more about various immigrant work visa types in detail.

  • EB-1 Visa:

Qualified foreigners with extraordinary abilities are given first preference for this work visa USA. Also, additional qualifications are set for such people that are mandatory for them to qualify for an EB-1 visa.

To acquire an EB-1 visa, you must have publications to your name, scholarly articles, awards, felicitations, certifications, commercial success, original contribution work, a high salary, and much more.

  • EB-1 Visa for Multinational Executive Immigrant:

The criteria to qualify for this Visa is similar to the L-1 Visa. (Employees working in the affiliate US-based company from another country.) However, with this visa, you will be appointed to work in managerial or executive positions. Hence, you must have at least three years of work experience.

  • EB-2 Visa:

The second preference is for people with advanced education degrees via EB-2 visa. As a result, having a bachelor’s degree may not work for you, so you must require a master’s or higher degree. Whereas, if you don’t have a master’s degree, you should have five years of work experience to qualify for the EB-2 Visa.

To obtain an EB-2 visa, your employer has to apply for the PERM certification process.
