When you apply for a US visa, you must submit manifold documents as part of your application. These documents will be used to assess your eligibility for a visa and will also be used during your visa interview.

For example, if you are applying for a student visa, you must submit evidence of your enrollment in the course of study. If you are applying for a US work permit visa, you must submit evidence of your employment offer. In addition to the documents specific to your visa category, you will also need to submit some general documents.

This article will give you proper guidance about the documents you need for a visa Interview. Read on!

Who Must Attend A US Visa Interview?

A US visa interview is required for anyone who wishes to enter the United States for any reason. This includes both business and pleasure travellers. The interview is conducted by a US consular officer at a US embassy or consulate and is required for all non-immigrant visa applicants.

There are numerous visa types, and each one has its requirements. The visa type you will need relies on the purpose of your visit.

  • If you are planning to visit the United States for business, you will need a business visa.
  • If you’re considering visiting the United States for pleasure, you will need a tourist visa.
  • And, if you plan to study in the US, you will need a student visa.

The US visa application process can be confusing, but it is important to ensure you apply for a US visa online correctly. The ideal way to do this is to consult an experienced immigration attorney or a visa consultant.

Once you have determined your visa, you must complete an application. The application will ask for common data about yourself, such as your name, address, and date of birth. You will also be asked to provide information about your travel plans, such as your flight itinerary and hotel reservations. After you have completed the application, you will need to submit it to the US embassy or consulate in your home country. You will also need to submit a photograph and pay a fee.

Once your application has been received, you will be scheduled for an interview. The interview is important for the visa application process, and it is your opportunity to demonstrate to the consular officer that you are eligible for a visa.

After the interview, the US visa consular officer will determine whether or not to approve your visa application. If your application is authorised, you will be issued a visa. If your application is denied, you will be given a reason for the denial.

What Necessary Documents Does One Need To Bring For A US Visa Interview?

1. A valid passport: You have to submit your passport when applying for a US visa. Your passport is accurate for at least six months above your intended stay in the US.

2. A nonimmigrant visa application: You must complete and submit a nonimmigrant visa application. This application is also known as the DS-160 form.

3. A photograph: You have to submit a recent photograph with your visa application. The photograph must meet the requirements specified on the visa application form.

4. Supporting documents: You must also submit additional documents, such as a birth certificate, marriage certificate, or evidence of financial support, with your visa application. These documents will be used to determine your eligibility for a US visa.

5. A visa fee: You must pay a visa application fee when you submit your application. The fee is non-refundable and must be paid in US dollars.

The documents you will need to submit for a visa depend on the US visa types you are applying for. For example, students applying for a student visa (F or M visa) will need to submit additional US visa documents, such as evidence of financial support and a SEVIS fee payment receipt. Business visitors applying for a B visa need to submit evidence of their business ties to the United States.

When you apply for a visa, you must submit the required documents and pay the visa application fee. You must also schedule an interview at a US consulate. ]]>
The H-1B visa is assigned to nonimmigrants by the employer, which allows them to work temporarily in the US.

Therefore, H-1B visa holders cannot permanently live and work in the US.

Wondering why?

Well, their stay depends on the visa’s duration date. When the duration date of the H-1B visa expires, the holders must leave the US and apply for a new work visa USA

Note: Workers who continue to work in the US with an expired H-1B visa are immediately deported and lose their legal status.

The US law states that an international worker can live up to six years in the US with an H-1B visa (including the number of extensions one can get).

However, it means that the original date of the H-1B visa is only valid for three entire years, which is extendable to another three years.

Once a nonimmigrant completes these six years in the US, they can acquire a different immigration status.

Must-know fact: The F-1 and O-1 visa holders often get a green card to stay permanently in the US. Otherwise, their visa’s eligibility lasts up to six to twelve years.

Now, let’s understand how the time is calculated for an H-1B visa according to US law.

How Much Time Does US Law Allow For The H-1B Visa For Foreign Candidates?

Before you get into the exact time count in the six-year H-1B visa validity, you must know how it is calculated in the first place.

  • A worker’s time in the US counts at the end of six years. Therefore, it won’t affect your H-1B status even if you have been to another country within this period, whether you leave the US or re-enter the US.

For example, suppose an Indian Citizen with an H-1B visa has a validity date from 1st February 2018 to 31st January 2021. During this period, the worker visited his family in his own country for three months. So, those three months won’t be counted from his H-1B status.

  • It is a significant law as it allows international candidates to get the most out of the six-year validity.

For example, the Indian Citizen having an H-1B visa from 1st February 2018 to 31st January 2021 has spent three months in his own nation, i.e., from 1st January 2019 to 31st March 2019.

As a result, the new validity of the work visa USA will be up to 30th April 2021.

  • The same H-1B concept applies to the L-1 visa holders, who can complete their six years in the US.

Discussing the L-1 status here is essential because some workers frequently shift from L-1 visas to H-1B visas.

So, let’s learn how they calculate the six years of their L-1 and H-1B status periods.

Similar to the H-1B visas, the recapture concept applies to L-1 visa holders. So, if they spend some time in another country from their allocated period, that time won’t be counted. Hence, the L-1 holders can apply the remaining time in their H-1B status.

Noteworthy point: The recapture concept is inapplicable to the dependents of H and L visa holders. The dependents must leave the US once their validity expires, even if they had stayed some time in another country.

To avail this opportunity, H-4 visa holders (dependents) must apply for an H-1B visa.

For example, a worker has an H-1B visa, and his wife accompanies him with an H-4 ticket. Now, the US government gives the right to spouses to change their visas from H-4 to H-1B. Then, they will be entitled to the recapture concept. Consequently, the spouse’s time on H-4 access won’t affect the H-1B status.

Now, we understand how the validity period is calculated in an H-1B visa. Let’s also look at some exceptions.

Exceptions In The Validity Of H-1B Visas:

Validity Of H-1B Visas

First Exception:

Usually, the maximum validity of an H-1B visa is six years. However, there are a few exceptions that can extend these six years as well. They fall under a US law known as American Competitiveness in the Twenty-First Century Act. It is also referred to as AC21.

An H-1B visa holder can extend the duration of the visa if they are the beneficiary and approved for an immigrant worker petition. The petition is filed under I-140 law. However, it doesn’t mean they will get an immigrant green card, as the H-1B visa date is not up-to-date.

For example, suppose you are an H-1B visa holder and have obtained I-140 in the EB-1 category. Now, your H-1B visa will expire on 30th April 2022.

However, your priority date is 15th April 2020, which means your cutoff date will be 21st April 2019. You can see that you don’t have a priority date before the cutoff date. Hence, you are ineligible to apply for immigration status.

In such cases, you can increase your H-1B visa till your priority date becomes up-to-date.

Second Exception:

You can apply for an H-1B visa process to extend its validity by filing the PERM or ETA application. In this scenario, the candidate’s employer files the petition on their behalf. The petition criteria are I-140.

Third Exception:

H-1B visa holders can extend the validity beyond six years via AC21 provisions. However, as these provisions have significant backlogs, the visa date sometimes extends to 10, 15, or 20 years.

Now, let’s look at another critical factor, i.e., how long the H-1B visa holders’ dependents can live in the US.

H-1B Worker’s Dependents Duration

The spouse of the H-1B visa holder possesses unlimited H-4 access and can continue to live with their husband. However, the exact condition is inapplicable to children as they cannot marry and should be under 21 years.

So, parents can obtain a green card for the family to permanently allow the child to live in the US. Otherwise, children can continue to live under F-1 status as students.

Many international candidates aspire to work in the US either on a short-term or permanent basis.

Therefore, employers grant temporary work visas to US immigrants to allow them to start their occupation soon. Also, it is easy and less expensive to hire foreign employees temporarily.

On the other hand, long-term employees get an E-B1 or E-B2 visa (green card) to stay in the US permanently.

Similarly, there are many work US visa types available for international candidates.

Let’s get into their detailing so that you can know which Visa will suit you. You will also learn about non-immigrant and immigrant visas.

Non-Immigrant Work Visas Types

Employers primarily grant non-immigrant visas to their future employees. They are temporary and thus, non-immigrants must depart from the country at the visa expiration date. Now, we’ll look at the temporary visa types one by one and understand each in detail.

  • H-1 Visa:

The most prominent nonimmigrant visa is H-1B. It is less time-consuming and easy for employers to approve it from USCIS.

Employees only get the H-1B visa when they have the employment offer letter from a US employer. Furthermore, concerned candidates must present all their job qualifications with suitable degrees.

In order to sponsor your H-1B visa, the employers need to file an I-129 petition at USCIS. It is also advisable for employers to seek legal help and hire a lawyer for the process of highly demanding H-1B visa USA. Any mistake in the form may lead to rejection.

  • L-1 Visa:

L-1 Visa is allocated to employees working in the affiliate US-based company from another country. Therefore, the L-1 visa allows employees to transfer from an international company branch to a US company.

To obtain the L-1 visa, employees should have worked in the foreign company’s branch for a year. It is again segregated into two categories, i.e. L-1A for managerial capacity and L-1B for specialized knowledge. Nevertheless, employers must file the I-129 petition for an L-1 visa to USCIS.

  • O-1 Visa:

Foreign candidates possessing specialized knowledge or expertise in any work field are granted an O-1 non-immigrant Visa. Your employer will produce your extraordinary skill set to obtain an O-1 visa on your behalf. However, candidates must satisfy at least three prongs to get this US work Visa.

  • Candidates have high remuneration in their field.
  • They have achieved outstanding contributions.
  • They have been awarded certifications.
  • Candidates have the best performance in their job role.

You must go through the US Visa process to acquire the O-1 Visa. Then, the concerned US employer will fill out the I-129 petition. Additionally, the petition will consist of a letter stating that the employee has no objection to US recruitment.

  •  E-1 Visa:

The US government provides E-1 visas to the countries’ nationals and permits them for trading activities. You can acquire an E-1 Visa as a treaty trader or investor. To qualify for this Visa, candidates must be nationals of the country involved in the trade treaty. Additionally, the applicants must have a healthy amount of money to begin the trade in the US and present some documents as proof.

You can fill out a US visa application form (E-1) at the US consulate in your country.

Note: For an E-1 visa, you don’t have to submit the document to USCIS.

  • TN Visa:

The North American Free Trade Agreement initiated the TN Visa, especially for Canadian and Mexican citizens. Thus, only Canadians and Mexicans can work in the US under this program. Also, they get three-year increment notice from US-based employers.

As it is only allocated to the citizens of Canada and Mexico, so they must submit their citizenship proof. Additionally, produce the employment letter and qualifications for the job role.

Today, the US-Mexico-Canada Agreement continues the application for the TN Visa. As a result, many companies hire accountants, lawyers, teachers, professors, scientists, and pharmacists from these countries under the TN Visa.

These were some non-immigrant work visa types. Now, let’s move further and look at immigrant work visas.

Immigrant Work Visas

Immigration visa stamp

The immigrant work visas for foreigners work as a lottery, as now they can permanently sit in the US and get citizenship. The US government also allows immigrants to relocate to the country with their families.

To qualify for immigrant work visas, your employer should agree to take the sponsorship for the visa program. So, let’s know more about various immigrant work visa types in detail.

  • EB-1 Visa:

Qualified foreigners with extraordinary abilities are given first preference for this work visa USA. Also, additional qualifications are set for such people that are mandatory for them to qualify for an EB-1 visa.

To acquire an EB-1 visa, you must have publications to your name, scholarly articles, awards, felicitations, certifications, commercial success, original contribution work, a high salary, and much more.

  • EB-1 Visa for Multinational Executive Immigrant:

The criteria to qualify for this Visa is similar to the L-1 Visa. (Employees working in the affiliate US-based company from another country.) However, with this visa, you will be appointed to work in managerial or executive positions. Hence, you must have at least three years of work experience.

  • EB-2 Visa:

The second preference is for people with advanced education degrees via EB-2 visa. As a result, having a bachelor’s degree may not work for you, so you must require a master’s or higher degree. Whereas, if you don’t have a master’s degree, you should have five years of work experience to qualify for the EB-2 Visa.

To obtain an EB-2 visa, your employer has to apply for the PERM certification process.

Seek Professional Help

To give equal preference to everyone, the US government has optimized several visas to suit international candidates’ backgrounds properly.

For example, if you have extraordinary skills, you can apply for an EB-1; to settle temporarily for employment, you apply for an H-1B visa, and so on.

Everyone who is applying for a US Visa or is rooting for a US Visa Interview may have fear of denial because of the different reasons available through which the embassy can deny your US Visa.

Even if you are having all the required documents for your US Immigration Visa, there are chances of a denial which will be fully based on the verification that has been done by the officials. So, when you are going to apply for a US Visa, make sure that there are no reasons left for the officials to deny your visa.

To make you understand the reasons why your visa can be denied, we are listing some of the main reasons for it.

Top 6 Unusual Reasons For A U.S. Visa Denial

1. Criminal Records

Those who are having some criminal records in their past will be facing certain difficulties in entering the country. This is because the government is strictly against those tourists and they are always working hard to provide their citizens with good safety.

Before applying for any US Visa type,  make sure that you have no criminal records. Even if you have any criminal records, then contact the embassy because there are some other programs that allow travelers to get visas. Therefore, contact your nearest embassy for it.

2. Medical Issues

A lot of tourists who are thinking to travel to the US will have to get their self-tests checked if they are having any serious kind of medical problems or not. There are various kinds of medical conditions in which the US does not allow a person to enter the country. Some of the medical conditions are alcohol-related issues, no vaccination, drug addiction, diseases, mental disorder, or something else.

If you are having this kind of issue, then make sure to get tested for it before as the authority will not allow you to enter the country and you will have to return back. There are some solutions too for this kind of problem, so you will need to contact the embassy about it to check whether they can help you with this or not.

3. Suspicious Media Content

The authorities who check for travelers always keep an eye on the social media thoughts that they are sharing. They will judge you on the thoughts that you have shared for a large audience and if they find that whatever you have shared is not up to the mark and according to their guidelines, then they will not let you enter the country.

A lot of travelers are there who have faced this issue. They have shared some inappropriate things on their social media accounts due to which they were not able to get into the country. When you are going to get your Visa and get to the country, then make sure that you have not shared something that is inappropriate to the government of the US.

4. Fraud

Audit And Fraud Investigation

When you are going to travel to the US, then you will have to give a list of the items that you are going to take with you. However, there are a lot of travelers who keep on hiding the items and try to cheat the officials. They simply lie with the item names and try to get those items in the country which is not allowed or mentioned. There are a lot of travelers who have done this and were caught doing fraud due to which they were not able to get to the US because their Visa was denied.

5. Documents Issue

It is very important for you to bring the original and correct documents required for a US Visa to the embassy, airport, and other places wherever the officials ask for them. There are many travelers who forgot to bring their original documents or they have made them by doing some edits due to which the documents required for the Visa don’t get fulfilled and the US Visa gets denied.

It is important for travelers that they should carry their official and original documents when they are going to the embassy or traveling to the US. It is much important for them that they should bring the original documents for verification, otherwise, their visa and entry will be denied by the authority and the embassy.

6. Violation During Past Immigration

There are a lot of travelers who often make mistakes during past immigration. They often stay more than the permitted time or without any authorization due to which they have to face the issue of Visa denial when they are applying for the new one. So, the visa will be only provided to you, if you have not violated any rule during the past immigration of your trip to the US.

What To Do If Your US Visa Gets Denied?

Getting your US Visa is not hard if you are consulting the right company. There are a lot of reasons why your US Visa can get denied. So, in this case, you will have to get the right guidance through which you will be able to resolve all the issues and get your Visa processed.

Did you know?

Having a criminal record of committing a certain crime may make you inadmissible to the USA.

Wondering how?

Over the past decades, the crime rate in the USA was comparatively high. The government of the USA then started working to stop it and they managed to decrease it to 47.70 per 100,000 people.

Everybody knows that the US is considered one of the best countries for traveling and immigration. A lot of people also apply for US job visas to work there.

However, there are some conditions that should be complied by travelers for the trip to the US or while applying for any of the US visa types. One of the things that they check is the criminal background of the people who are traveling there.

To maintain the integrity of the country, they have made some rules for those who have committed crimes in the past. If you are thinking of traveling, then do check it to know whether you will be able to get the entry or not.

What Crimes Make Immigrants Inadmissible To The U.S.?

1. Crimes That Involve “Moral Turpitude”

Moral turpitude is a crime that involves murder, prostitution, bribery, forgery, tax invasion, etc. Those who have committed this type of crime will be inadmissible to the US.

The US Government is strictly against this type of crime and it is also strictly prohibited in the country. Due to this, the government of the US doesn’t want to give entry to those who have committed such crimes and will be a danger to the citizens and society who are living there.

However, there are two exceptions for the criminals who have done this.

  • Minors who are under the age of 18 years. In this case, those who have committed this crime, but were released with a gap of more than 5 years before applying for the visa will be able to get entry to the country.
  • A person who has committed the crime but was released within 1 year of time.

2. Violation Of Controlled Substance Law

The controlled substance law is related to the law of drugs whether it’s in the US or another country. You will be inadmissible to the country if you have violated the substance law which means you were found with those drugs which are strictly for no use in your country like opium, heroin, peyote, etc.

For any such violation, you may find it difficult to get your USA immigration Visa.

3. Criminal Convictions

Any person who has been convicted of two or more than two crimes will be not granted entry into the US. It will be implemented if the person who has done the crime was sentenced to five or more than five years in prison. It can be from a single crime or might be of both crimes. Those who have committed the crimes will be inadmissible to the US.

4. Drug Trafficking

If any officer knows or has reasons to believe that the person who is coming has been involved in drug trafficking will be inadmissible to the US. This will be implemented for all of the controlled substances which come under the law. It is only done to keep the citizens of the US away from this type of drug in the country.

5. Prostitution

Those who are coming to the US with a mindset to get involved in prostitution, or have been involved in prostitution within 10 years of when they apply for the visa will be inadmissible to the US. Similarly, those people will be also inadmissible who have earned some profit from prostitution. This is done to lower the crime rate in the country.

6. Money Laundering

Anyone who is coming to the US with the purpose to get involved or has been involved or thinking to enter the United States with the purpose to get into money laundering will be inadmissible. This is implemented to stop those people who are coming with a mindset to earn illegal money by fooling people.

7. Violations Related To Religious Freedom

Those who were serving as foreign government officials were responsible for the directly carried out severe violations of religious freedom will be inadmissible. This law is imposed, so that, the government of the US can provide their citizens with safety and peace related to their religious freedom

8. Human Trafficking

Anyone who is involved with human trafficking will be not allowed to enter the country. Some examples of human trafficking are child labour, forced labor, sexual exploitation, organ removal, forced marriage, child soldiers, and much more. Those who are involved in any of these crimes will be inadmissible to the US.

How To Avoid These Crimes

Those who have committed any of the crimes which are mentioned above, then they will not be able to travel to the US. However, we will suggest that you should consult the embassy or the consultant company to check whether there is any way to travel to the US or not.

There are different programs that are run by the government which let some of the criminals travel to the respective company with all due permission of the government with proper authority. All the security checks are performed by them to let them enter the country.

You can also travel to the US with certain conditions which will be imposed on you by the government. For this, you will have to contact the embassy or the consulting company that can help you with this. Through which you will be only able to get admissible to the US.

Seek Professional Help

Anyone who has committed a crime will be facing a lot of issues when they are traveling to other countries. The government of every country does this to maintain the safety and peace of the citizens who are living there.

However, there are a lot of travelers who travel to another country with the proper authority which is given after a proper interview by the embassy. For some crimes, the granting rate is very less as border security doesn’t want any criminal to get into the country.
For this, you can consult Work Permitz to get expert advice and smoothen your US Visa process!

Getting the US visa interview date needs a lot of hassle!

To begin with, there are very limited slots available for the interview and if by chance you get any slot available, it can get filled in a few seconds. Another issue is that there is limited slot availability. Well, this makes it a lot more difficult to get assured interview dates.

However, if you act right at the right time, booking the US visa interview date is no big deal. Therefore, to help you grab the appointment slot, we have come up with some tips and tricks for you. But before that, let’s understand the expected waiting time you may have to wait for the interview.

Estimated Waiting Time For US Visa Interview Date

According to the US Department of State, if you are applying from major cities, you may have to wait for the following time:

  • Mumbai: 459 days for the student visa and 596 for the visitor visa.
  • Kolkata: 465 days for a student visa and 592 for a visitor visa.
  • Hyderabad: 458 days for a student visa and 609 days for a visitor visa
  • New Delhi: 458 days for a student visa and 629 days for a visitor visa.

However, with increasing applicants, this waiting time is more likely to increase and in case of workload and staffing issues, the embassy may decide to change this waiting period. This is why before planning your trips, it is always a better idea to confirm from the embassy.

Get US Visa Interview Dates With These Three Tips

Young man sitting in the waiting room

Get an I-20 by applying to a university

Look for the universities which release the i-20 sooner than others. This is because by the time other people will wait for their I-20, you will be the one booking your visa date. This will increase your probability of securing the date. Moreover, when you secure the US visa interview date, you will still have a chance to modify the university a week prior to your interview.

All you need to do is to update the DS 160. However, if you are not sure which university will release the I-20 sooner and what your options are, you can consult experienced consultants at Work Permitz. The team will help you find the best option available for you.

Avoid Rescheduling Interviews

Rescheduling your US visa interview dates is a big NO! Though the fees you pay at the time of your US visa application are valid for a whole year, you can reschedule the date only twice. If you choose to reschedule your interview date more than twice, you will have to pay the penalty fee.

But there’s a catch!

In case you have rescheduled your date for the first time and it gets cancelled then you won’t be able to reschedule the date for the next 90 days. So, there is always the underlying risk of your appointment being cancelled. Therefore, it is advised to stick to the schedule and avoid rescheduling your visa interview date. But if there is no way you can make it to the interview on the scheduled date, taking the risk of rescheduling is all you can do.

Be Patient

Patience is the key to getting US visa interview dates! With limited attempts to book an interview, it is important to be patient. This is because if you book a date and fail to do so because of any reason, one attempt will be reduced.

To book your date, you will get 12 attempts in total and when you will be booking your dates for the 12th time, you may come across warnings. In case you choose to ignore those warnings, you will be blocked from logging in for the next 72 hours. Therefore, to avoid this situation, make sure that you do not exhaust your attempts and book your appointments patiently.

Documents Required For US Visa

You will have to carry certain documents when you apply for the US visa interview or while you are going for an interview. Make sure that you carry copies and originals of the following documents on the day of your interview.

  • Passport: Make sure that your passport is valid for 3 months minimum after coming back from the US and must have 2 blank pages.
  • DS-160 form: Carry the original completely filled application form.
  • Financial Documents: Make sure to carry the documents to support your financial status and ensure the officials that you have enough funds to manage your living expenses or studies. This includes your income tax returns, property documents, bank statements and pay slips.
  • Photograph: Carry 2 coloured recent passport photographs.
  • Retirement proof: In case you are retired from your job, make sure to carry your pension book to the US consulate.
  • Trip Itinerary: keep a detailed itinerary of the trip including the places you will visit, tourist attractions, scheduled hours, travel dates, meeting agendas and more.
  • Proof of Employment: Submit a leave application from your company as well as your pay slips.
  • Education Proof: carry your school, college ID or degree to provide proof of your education.
  • Business proof: Submit documents related to your business including partnership deed, business license and company bank statements.
  • Minor Traveler: In the case of a minor traveller, you will have to submit your birth certificate and NOC to the parents along with their ID proofs.
  • Invitation letter: In case you are invited by a friend or family member, you will have to submit the invitation letter along with the passport of the inviter.
  • Letter of Sponsorship: in case you are being sponsored, carry the financial documents and passport ID of the sponsor.
